In an effort to balance the Gotham Knights with the initial threats they will be encountering I am sticking to the rule that your Defense and your Toughness cannot be bought over the current power level (which is 10.)
Also, I am capping all Skills at the current power level (which is 10.) Keep in mind a 10-12 in a skill is best in the nation!
With that being said to offer you guys some variety I am giving you each 3 points (which you must pay for as normal) to exceed a cap or caps of your choice. For instance, if your character is exceptionally good at Stealth you might place your points in that giving him a 13 (which is world renown) or if your character is exceptionally trained and you want it to reflect his Defense then you may place them there. *Keep in mind that these extra points do not allow you to have your Toughness and Defense combined exceed a 20!
Also, I've been looking through the core book. I don't know if this was going on because I wasn't certain of the rules at the time but you can't actually buy Toughness like you can Defense. Toughness only comes from feats and powers and it follows the same rules as normal. So you can't actually buy 10 ranks of Toughness and then add something like a force field on top because you can't legally buy ranks of Toughness.
